By creating an account or using Swapsly, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service. You must be at least 18 years old to use Swapsly.
Swapsly is a platform that lets users list, request, offer, sell, and trade second-hand items with one another. Swapsly is a venue that connects users; unless expressly stated, we are not a party to, and not responsible for, transactions between users. Payment for physical goods takes place directly between users, off-platform.
You are responsible for your account and the accuracy of your listings. You agree not to post illegal, counterfeit, stolen, or prohibited items, not to defraud other users, and to comply with all applicable laws.
Prohibited items and content include, without limitation: illegal, stolen, counterfeit, or recalled goods; weapons, firearms, ammunition, and explosives; drugs, controlled substances, and related paraphernalia; alcohol, tobacco, vapes, and nicotine products; hazardous or regulated materials; live animals and protected wildlife products; adult or sexually explicit material; and any item whose sale or trade is restricted by law. See our Prohibited Items policy for the full list. We screen listings automatically when they are posted and act on reports from the community.
Swapsly has zero tolerance for objectionable content and abusive behavior. You may not post, send, or share content that is unlawful, harassing, hateful, threatening, sexually explicit, fraudulent, or that infringes others' rights, and you may not abuse, harass, or harm other users.
You can report any listing, profile, or message and block any user directly in the app. We review reports of objectionable content and abusive users and will act on them — including removing content and suspending or terminating accounts — within 24 hours. By using Swapsly you agree there is no tolerance for such content or conduct.
Users are solely responsible for evaluating items, meeting safely, and completing exchanges. Swapsly does not process payments for physical goods and is not responsible for the quality, safety, legality, or delivery of items traded or sold between users.
You retain ownership of content you post, and grant Swapsly a worldwide, non-exclusive, royalty-free license to host, store, and display it as needed to operate the service.
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Swapsly is not liable for user conduct or for damages arising from transactions between users.
We may suspend or terminate accounts that violate these Terms or the community guidelines above. You may delete your account at any time from Settings, which permanently removes your account and associated data.
We may update these Terms; continued use after changes constitutes acceptance.
These Terms are governed by the laws of [STATE/COUNTRY], without regard to its conflict of laws rules. You and Swapsly agree that the courts located in [CITY, STATE/COUNTRY] have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the service, and you consent to personal jurisdiction there.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@swapsly.com and allowing 30 days to respond.
Disputes between users — over an item, a trade, a meetup, or a payment made off-platform — are between those users. Swapsly is not a party to them and does not arbitrate them, though we will act on reports of prohibited items, fraud, or abusive behaviour as described in section 4.
